Terms & Conditions for The One Group Program

Introduction:

These Terms and Conditions ("Terms") outline the agreement between Rawinia Judson, hereinafter referred to as "the Provider," and the participant, hereinafter referred to as "the Participant," for the The One Group Program ("the Program"). By enrolling in the Program, the Participant agrees to abide by these Terms. Please read them carefully.

Program Description:

The One Group Program is designed to provide participants with guidance, education, and support related to mindset and holistic techniques and practices to support well-being. The Program includes online sessions, resources, and materials to help participants develop their awareness, skills and experience the potential benefits.

1. Program Requirements:

1.1. Eligibility: The Participant must meet any eligibility criteria specified by the Provider to enroll in the Program.

1.2. Commitment: The Participant agrees to actively participate in all scheduled Program sessions and complete any assigned coursework or exercises, to the best of their ability.

2. Program Fees:

2.1. Payment: The Participant shall pay the applicable Program fees as specified by the Provider. Payment is due upon enrollment unless otherwise stated by the Provider.

2.2. Refunds: No refunds are permitted for change of mind and are permitted only with extenuating circumstances to be decided at the discretion of the Provider.

3. Participant Conduct:

3.1. Respect: The Participant shall treat all Program participants, instructors, and the Provider with respect and courtesy. Disruptive or disrespectful behavior will not be tolerated.

3.2. Confidentiality: The Participant shall respect the privacy and confidentiality of other participants in the Program. Information shared during the Program should not be disclosed without explicit consent.

4. Program Changes:

4.1. Cancellation: The Provider reserves the right to cancel or reschedule Program sessions or make changes to the Program content at its discretion. In such cases, the Provider will make reasonable efforts to notify participants in advance.

5. Medical Waiver:

5.1. Health Assessment: The Participant acknowledges that breathwork and somatic practices, like any physical or wellness activity, may have potential physical, emotional, or psychological effects. The Participant agrees to undergo a self-assessment of their health and consult with a qualified healthcare professional before participating in The One Program to ensure that they are in suitable physical and mental condition.

5.2. Responsibility: The Participant acknowledges and assumes full responsibility for their health and any risks associated with participating in the Program. The Provider is not a medical professional, and the Program does not constitute medical or psychological advice, diagnosis, or treatment.

5.3. Health Conditions: The Participant shall disclose any pre-existing medical conditions, allergies, medications, or other health-related concerns to the Provider prior to participating in the Program. It is the Participant's responsibility to ensure that their participation in the Program is safe and suitable for their individual circumstances.

5.4. Assumption of Risk: The Participant understands that there are inherent risks associated with breathwork and somatic practices, which may include, but are not limited to, changes in breathing patterns, altered states of consciousness, and emotional releases. The Participant assumes all such risks voluntarily.

5.5. Waiver and Release: The Participant hereby releases, discharges, and holds harmless the Provider, its instructors, agents, and affiliates from any and all claims, liabilities, actions, demands, damages, costs, or expenses arising out of or related to their participation in The One Group Program.

5.6. Continued Monitoring: If, during the course of the Program, the Participant experiences any physical or psychological discomfort, pain, or adverse effects, they agree to discontinue participation immediately and seek appropriate medical or psychological attention.

The Participant acknowledges that they have read, understood, and agreed to the terms of this Medical Waiver and that they have taken appropriate steps to assess their health and consult with a healthcare professional as necessary before participating in The One Group Program.

6. Liability and Release:

6.1. Health Disclaimer: The Participant acknowledges that participation in the Program may involve physical or emotional challenges and should consult with a medical professional before starting any new wellness or health program.

6.2. Assumption of Risk: The Participant acknowledges and accepts all risks associated with participating in the Program and releases the Provider from any liability for injuries, damages, or other claims that may arise during or as a result of participation.

7. Intellectual Property:

7.1. Ownership: All Program materials, including but not limited to documents, videos, and resources, are the intellectual property of the Provider and are protected by copyright. The Participant may not reproduce or distribute these materials without the Provider's prior written consent.

8. Termination:

8.1. Termination by Participant: The Participant may choose to withdraw from the Program at any time, but no refunds will be issued as per the Provider's refund policy.

8.2. Termination by Provider: The Provider reserves the right to terminate a Participant's participation in the Program if they violate these Terms or if their behavior is disruptive to the Program or other participants.

9. Testimonials and Use of Image and Likeness:

9.1. Consent for Testimonials: The Participant agrees that the Provider may use their name, image, likeness, and any written or verbal feedback provided during or after the Program for promotional purposes, including but not limited to testimonials, marketing materials, social media, and the Provider's website.

9.2. Release of Rights: The Participant hereby grants the Provider an irrevocable, worldwide, royalty-free license to use their name, image, likeness, and feedback without any further compensation or notification.

9.3. Withdrawal of Consent: If the Participant wishes to withdraw their consent for the use of their image, likeness, or feedback, they must notify the Provider in writing at hello@rawiniajudson.com. Upon receipt of such notification, the Provider will make reasonable efforts to cease using the Participant's information for promotional purposes, but this may not apply to materials already in circulation.

By enrolling in The One Group Program, the Participant acknowledges and consents to the use of their image, likeness, and feedback as described in this clause.

10. Governing Law:

10.1. These Terms and the Program shall be governed by and construed in accordance with the laws of New Zealand

11. Entire Agreement:

11.1. These Terms constitute the entire agreement between the Provider and the Participant regarding the Program and supersede all prior agreements, oral or written.

By enrolling in The One Group Program, the Participant acknowledges that they have read, understood, and agreed to these Terms and Conditions. Failure to comply with these Terms may result in the Participant's removal from the Program without a refund.
